BREAKING: New York State Supreme Court Justice Ronald Castorina, Jr. Sued By Richard Luthmann for Unpaid "Fake Facebook," Political "Fixing," and Other Claims
Luthmann Asks for Damages of $62,387.06 for the Benefit of His Creditors, “Including the United States and Its Taxpayers.”
Richard Luthmann, a former attorney and writer for this publication, is suing Ronald Castorina Jr., a former New York State Assembly member, and a current New York State Supreme Court Justice. The suit, filed in Albany County, New York, claims breach of contract and other relief. Luthmann alleges Justice Castorina hired Luthmann to perform general legal and other work related to candidate Justice Ronald Castorina’s activities while he was an Assemblyman.
Luthmann says he is owed for work involving political strategy, social media strategy, political “fixing,” and other issues.
Castorina’s campaign committee, Castorina for Assembly, is also named in the suit, as is the New York State Board of Elections (NYSBOE). The papers say NYSBOE is named as a necessary party for applicable notice purposes, the custodian of necessary books and records, and “its independent enforcement powers may resolve this dispute before judicial intervention.”
Justice Castorina commissioned Luthmann to create a “fake Facebook” page against rival candidate Janine Materna in 2016. The fake Facebook page was developed and operated by Luthmann with Justice Castorina’s full knowledge and consent. Luthmann was promised $20,000 for the fake Facebook page by Justice Castorina and additional amounts for services rendered in connection with Castorina’s political activities.
Justice Castorina knew that Luthmann previously operated a fake Facebook page against District Attorney Michael E. McMahon during the 2015 Richmond County District Attorney’s race. Justice Castorina communicated with Luthmann over Facebook Messenger. Their conversations are attached as an exhibit to the lawsuit.

Justice Castorina’s grand jury testimony directly contradicts Facebook Messenger messages between Justice Castorina and Luthmann and telephone records offered into evidence and presented to the grand jury. Special Richmond County District Attorney Eric Nelson suborned Castorina’s sworn testimony. Justice Castorina perjured himself as Special Prosecutor Eric Nelson’s “star witness,” then a sitting NYS Assemblyman and judicial candidate.
Evidence preservation letters were sent to potential witnesses. One recipient was Sean O’Sullivan, an attorney who has had dealings with Luthmann and Ronald Castorina Jr. O’Sullivan and Castorina are business partners, the lawsuit alleges.
Phone records show that Justice Castorina initiated numerous calls with Luthmann. One call in August 2017 occurred while O’Sullivan was present with Luthmann at the “Miracle on Ice” arena in Lake Placid, New York. The trio discussed a Facebook post that Luthmann was crafting to exonerate Castorina politically and relieve pressure for him to resign as Staten Island GOP Chairman. Castorina knew that some of the post's contents were false but testified to their complete veracity at a grand jury hearing, committing perjury.
In addition, Castorina and his campaign failed to report the Luthmann engagement to the New York State Board of Elections, making Castorina’s campaign liable for penalties.
The plaintiffs have requested a trial by jury and have asked for damages in the amount of $62,387.06 for the benefit of Luthmann’s creditors, “including the United States and its taxpayers.” The plaintiffs also ask for attorney fees, costs, and expenses incurred in connection with this action.
