Kamillah and Kevin's Last Juneteenth Together?
Did NYC Councilmember Kamillah Hanks' "Husband" Kevin Barry Love Lie to Federal Agents and Commit Interstate Menacing?
Kevin Barry Love was incensed when he got wind that Richard Luthmann would sue him, his “wife” NYC Councilwoman Kamillah Hanks (they are not married), and their 2017 City Council Campaign for over $87,000 in unpaid legal fees. As previously reported, Love took the matter into his own hands and made a slew of phone calls.
Love is used to making calls and strong-arming adversaries. Since before she was elected, Love has been the “fixer” for Kamillah Hanks. This millionaire real estate developer has held meetings and “represented” Hanks’ campaign and office.
The starkest example is the recent deal that Kevin Barry Love struck with Staten Island Republicans to have Hanks run unopposed in her upcoming 2023 NYC Council Race. “No one doesn’t put up a candidate with 8 to 1 matching funds, if only just to pay their party faithful to work for the campaign. The Republicans must have gotten something very juicy,” said an unnamed New York City political consultant.
But when facing legal issues, it’s usually not wise to handle the matter on your own without the aid of counsel. Today, Kevin Barry Love appears to be the sharpest spoon in the drawer.
Tortious Interference With Contract and Interstate Menacing
On April 4, 2023, Love called Luthmann’s collections lawyers and threatened them if they proceeded with his case. Love’s activities smack of interstate menacing.
As a result of Love’s phone call, Luthmann’s collections lawyers withdrew the collections case against him, Kamillah Hanks, and the Hanks Campaign (without Luthmann’s knowledge or consent).
Love’s actions are textbook tortious interference with contract. New York law allows recovery where a person, without justification, knowingly procures the breach of a contract between two parties to one of those parties’ detriment.
Further, Love opened up to a new lawsuit and rebaptized a three-year statute of limitations because he knew the lawyers he called were Luthmann’s. His call aimed to intimidate them into unjustifiably dropping the case and canceling their contract with Luthmann, which they did.
The Providence and NYC FBI Offices received complaints about Love’s April 4, 2023, intimidating phone call to a law office.
But Love’s biggest problem may be that he was not truthful in his communications.
Federal Investigation and Lies to an Agent
Admittedly, Kevin Barry Love called the FBI and the DOJ about Luthmann’s collections case.
Love told the FEDS that Luthmann was “intimidating” him and his “wife” and engaged in extortion. Further, Love told the authorities he and his wife were “witnesses” in Luthmann’s 2019 federal conviction for wire fraud (which Luthmann contests).
“I was told to stop collections against Kevin Barry Love, Kamillah Hanks, and their campaign because there was an investigation based on a statement made to federal authorities. I know Kevin Barry Love made the statement because he admitted as much. And I know the statement was false because I was told that the FEDS can’t establish that Love was ever a victim or witness against me,” Luthmann said.
He continued, “I think what clinched it for the FEDS was that Love regularly tells anyone who will listen about the ‘small fortune’ he spent in 2018 to avoid having himself or Kamillah Hanks testify at the ‘Fake Facebook’ grand jury hoax. That brain surgeon didn’t think the FEDS would call up all the other people he stiffed and get the full story?”
Love’s statements to federal authorities appear to be false misrepresentations. If so, Love may have jammed himself up under 18 U.S.C. § 1001. It is a federal crime when a person dealing with a federal agent “makes any materially false, fictitious, or fraudulent statement or representation.”
“If these facts are true, there is genuine potential for a criminal case against Kevin Barry Love. The only question is whether a US Attorney’s Office will decide to prosecute him. It looks like his activities have touched at least three jurisdictions: the District of Rhode Island, the Middle District of Florida, and of course, the Eastern District of New York,” said an unnamed Brooklyn criminal attorney.
“Never talk to the authorities without the benefit of counsel. This case may become a cautionary tale about why you should always hire a lawyer to make communications that may otherwise be misconstrued or misinterpreted, especially by law enforcement looking for a collar. From what I heard, Love has problems,” the Brooklyn attorney said.
A Deadbeat and Loudmouth
Luthmann says Love is a “deadbeat” and a “loudmouth.”
“Kevin’s mouth has always gotten him in trouble. He looks like a real fool the way he is carrying on to avoid paying some bills. He just can’t help himself.”
“He owes earned fees, and I will make him pay, one way or another, using the legal process. It’s unavoidable because the proceeds of any monies collected go to the US Government and its taxpayers to cover the restitution I owe,” Luthmann said.
“There will be a court hearing about my case in the next few months. Kevin and Kamillah claim that I have ‘libeled’ them by pursuing a valid debt and telling the truth and my opinion. I intend to subpoena them. If they want their allegations to retain any life, they should have no problem telling their side of the story, as Kevin previously told the FEDS he would do. And then I will have the right to cross-examine them. Get your popcorn ready.”
Luthmann says the Government’s directive to pause all collections activities is a de facto taking under the Fifth Amendment’s Takings Clause. “I will have a hearing to force the Government to permit me to exercise my property rights to collect, compensate me for the mounting losses due to their improper directives, and restrain such activity in the future. In the alternative, I will ask the Government to credit the over $500,000 in collectible legal fees against my restitution. They can’t have it both ways. It’s not ‘heads I win, tails you lose,’ at least not when you are playing with Luthmann.”
Luthmann also thinks that Love will go down unless the government is corrupt.
“I can’t see a more open-and-shut case, in my opinion. And I think there is much more there if the FEDS keep digging. I believe Kevin to have brokered many ‘pay-to-play’ deals that deserve scrutiny,” Luthmann said. “My concern is my connection to Trump, Trumpism, and America First, and continued retaliation by the Deep State. To those elements, the shot-callers in government, I am a thought criminal of the first order that must be silenced. And that’s tyranny.”
Luthmann continued, “Kevin doesn’t have many ‘prison-translatable skills.’ Maybe he can take people to the showers for a book of stamps, and if the rumors are true, he’d probably enjoy it. But I do not think his relationship with Kamillah, whatever it is, will survive an indictment. I think she will run from him, politically and personally. They should enjoy this Juneteenth together. It might be their last.”
“A year from now, they will look at $100,000 as a bargain when they consider what having their actions come to light will have cost them.”
