Luthmann Files Motion To Vacate Fake Facebook Felony Conviction In Richmond County Supreme Court
Luthmann Also Calls for Judge Mundy to Remove Special Prosecutor Eric Nelson For Serious Misconduct Including Multiple Felonies, and Refer the Matter to NYS Attorney General Letitia James
Today, Richard Luthmann sent a detailed motion for filing in New York Supreme Court, Richmond County. NYS Supreme Court Justice Marina C. Mundy will hear Luthmann’s request, with a return date of February 14, 2023.

Also included are Special Prosecutor Eric Nelson’s $700,000+ in billing records obtained from the NYC Comptroller’s Office. Luthmann claims Nelson has “bilked” New York City Taxpayers.
“I’m ready for a fight,” Luthmann said. “These Swamp Creatures committed multiple felonies to get a bogus felony indictment on me to stick. I did three years for Fake Facebook satire and lampooning. They should all do at least three years and a day for extreme violations of the public trust,” Luthmann said.
“I’ve lost everything and truly been humbled,” Luthmann said. He continued, “This is my first step in taking back my life. I want a St. Valentine’s Day Massacre.”
Luthmann asks Judge Mundy to disqualify Special Richmond County District Attorney Eric Nelson. Luthmann claims Nelson committed unprecedented prosecutorial misconduct, including the felonies of aiding and abetting the unauthorized practice of law and the subornation of perjury of Judge Ronald Castorina, Jr.
Frank Report Investigative Journalist Frank Parlato broke the story on Judge Ronald Castorina’s August 1, 2018, perjury at the grand jury proceeding conducted by Nelson. The grand jury issued an indictment based on Castorina’s testimony and Nelson’s presentation.

Luthmann also asked Judge Mundy to vacate his felony conviction and dismiss the Indictment with prejudice. Luthmann claims Castorina’s perjured testimony, Nelson’s legal consultations with Perry Reich, a disbarred former attorney who did prison time, and other material and prejudicial irregularities violated Luthmann’s rights under the Grand Jury Clause of the New York State Constitution.
If granted, Luthmann will walk away scot-free.
Luthmann also asked Judge Mundy to refer this matter to proper Attorney Discipline Authorities and New York State Attorney General Letitia James for investigation and prosecution.
Luthmann previously filed an official Public Corruption Complaint with the Office of New York Attorney General Letitia James’s Public Corruption Unit. Along with the Complaint, Luthmann filed a touching letter to General James, thanking her and her office for their work in pursuing social justice and prisoner’s rights.
