Feudal Court Delayed Another Week
Today Our Hero, Luthmann, was looking forward to a rousing argument against the Special Schmuck. It was not to be. The Feudal Court on the Isle of Staten was postponed. No one from the Court called Luthmann to tell him. But Luthmann was excoriated for having the audacity to leave a message on the Court’s answering machine. How does Luthmann get any semblance of due process from these people if they get angry when Luthmann wants to have proper notice of when the hearing is and have an opportunity to be heard? Are these the actions of a neutral decisionmaker? Next week we shall see what the salty scallywag seadogs of Staten Island have in store for Our Hero. More on this below.
On The Radio
Having little else to do today, Luthmann did his best Donna Summer impersonation and appeared on Frank Morano’s Radio Show: The Other Side of Midnight. The Award-Winning Talk Show Host put together a panel of three “ex-attorneys who are also ex-felons.” Joining Luthmann were Domenick Crispino and Andrew McKenna to provide commentary on a wide range of legal topics in the news. The panel lasted for a full hour and was divided into three segments.

New York Congressional and State Senate Redistricting Decision
Crispino, McKenna, and Luthmann delved into the recent Election Law case issued by the New York State Court of Appeals, New York’s highest court, on the issue of redistricting of New York’s Congressional and State Senate districts.
In a majority 4-3 decision, the high court ruled that the maps must be redrawn by a neutral expert, ordering the Supreme Court, Steuben County, to oversee the process. As a result, “it will likely be necessary to move the congressional and senate primary elections to August,” Chief Judge Janet DiFiore wrote.
While the court ruled both maps were procedurally unconstitutional, the judges wrote that the congressional map was gerrymandered “with impermissible partisan purpose.”
The decision comes after the new, bipartisan Independent Redistricting Committee, established by NYS Constitutional Amendment in 2014, could not agree on the electoral maps. As a result, the Democrat-controlled state Legislature approved newly redrawn maps in February.
“The legislature responded by creating and enacting maps in a nontransparent manner controlled exclusively by the dominant political party – doing exactly what they would have done had the 2014 constitutional reforms never been passed,” DiFiore wrote.
Luthmann raised the point that Senate Majority Leader Andrea Stewart-Cousins didn’t do herself any favors when she said that the district lines were re-drawn to exclude Republicans.
Luthmann also commented that the NYC Democratic Congressional delegation might be the unintended beneficiary of the ruling because the proposed NY-11 district map that “fingered” through liberal parts of Brooklyn into Park Slope heavily favored Democrat Max Rose in his bid to unseat incumbent Republican Nicole Malliotakis. With the expected new maps, Malliotakis will likely keep her seat. And as the only Republican in the NYC Congressional delegation, after the anticipated Red Wave in November, at least NYC Democrats will have someone to approach to carry their legislative priorities to the other side of the chamber.
Johnny Depp vs. Amber Heard
The conversation next turned to the celebrity defamation trial between movie stars Johnny Depp and Amber Heard in Federal Court in Northern Virginia. Both Crispino and McKenna agreed that they thought it would be tough for Johnny Depp to prove damages even if he were to prove defamation. Luthmann disagreed, citing Depp’s testimony that he had created the Captain Jack Sparrow character from the “ground up” but was then treated “guilty until proven innocent” by Disney based on Heard’s domestic abuse claims and denied a part in the latest Pirates of the Caribbean movie.
Luthmann also said that Johnny Depp’s acting ability made Amber Heard’s lawyers look like a Clown Show, citing Depp’s mocking of hearsay objections and turning what was intended to be damaging testimony into a humorous moment. Luthmann believed that Johnny Depp had already won the jury and that Amber Heard had a “hole” to climb out of with her testimony.
The Conditions on Riker’s Island
After Luthmann reminded everyone about the May 6 court appearance in People v. Luthmann, the Second Segment of Frank Morano’s panel discussed the deplorable conditions at Riker’s Island and the real possibility that Chief Judge Laura Taylor Swain (S.D.N.Y.) may order a Federal Takeover of Riker’s Island. Luthmann thought that the suggestion that the Feds would take over Riker’s was rich, mainly because the Feds can’t manage their NYC-based lock-ups.
Frank Morano raised the issue of putting a court on Riker’s Island or doing proceedings via video to cut costs. Domenick Crispino, who was on “extended vacation” at Riker’s, confirmed a habeas corpus court part, and sometimes the Bronx D.A. prosecuted cases arising on the island from within the facility. Luthmann raised the critical point (which forms the basis of Luthmann’s currently pending appeal) that Article 182 of the Criminal Procedure Law does not allow for electronic appearances for arraignments, pleas, and sentencing:
Luthmann contends that video appearances by Defendant-Prisoners from Riker’s Island (or any New York State correctional facility) would require a Bill by the New York State Legislature and signed by the Governor amending the existing Criminal Procedure Law.
Biden’s Pardons and Commutations
Crispino, McKenna, and Luthmann agreed that President Biden’s recent pardons and commutations were relatively insignificant compared to larger criminal justice problems. Luthmann and McKenna agreed that Biden’s 1994 Crime Bill was responsible for a disparate impact on communities of color based on a 100 to 1 drug weight disparity between crack cocaine and powder cocaine. McKenna further traced the issues back to legislation in the 1970s.
Luthmann said that the pardon of 87-year-old former Secret Service Agent Abraham Bolden almost sixty years after the fact was “too little too late” and said that Bolden’s 1964 claims about the FBI and Federal Law Enforcement’s role in the JFK assassination make much more sense in the climate of today’s FBI. Crispino went so far as to suggest pardon at such a late date has about the same effect as a pardon of Brutus for Julius Ceasar’s murder.
Luthmann also pointed out that the vast majority of the seventy-five commutations that Biden issued were for individuals who were already in home confinement because of COVID-19.
Donald Trump vs. Letitia James
The panel addressed the $10,000 a day Contempt Order issued against Donald Trump by a New Court on Tuesday related to AG Letitia James’ probe into the Trump organization’s business practices. McKenna and Crispino agreed that the Contempt Order would have been avoidable if Trump’s attorneys had submitted an affidavit to the court sworn out by someone with personal knowledge to satisfy the New York AG’s request to locate documents. Instead, Trump’s lawyers submitted an affirmation by an attorney without personal knowledge and did not particularly describe the places searched.
Luthmann said that Trump’s lawyers we screwing up “up and down.” Luthmann echoed the opinion of Harvard Law Professor Emeritus Alan Dershowitz, who said that Letitia James and the AG’s office should be disqualified in the Trump case. Luthmann marveled that Trump’s attorneys have filed no motion to disqualify Letitia James based on the AG’s campaign promise, “I’m gonna get Trump.” Luthmann said that Letitia James’ conduct merits disqualification because of the overwhelming appearance of impropriety and is reminiscent of the Soviet KGB’s “show me the man and I’ll show you the crime” ethos.
McKenna, Luthmann, and Crispino were unanimous that appointed law enforcement is preferable to elected law enforcement. Luthmann cited the Former Brooklyn District Attorney Joe Hynes - John Kennedy O’Hara scandal for the proposition that “political hacks” don’t stop being political hacks just because they are elected to a law enforcement position, and private vendetta using the machinery of government is often the result.

Luthmann’s May 6 Court Appearance
Luthmann closed by reminding everyone of his court appearance in the Feudal Courts on May 6, 2022. The Feudal Courts canceled the showdowns scheduled for April 7, 2022, and then April 28, 2022.
Maybe Luthmann will finally find out what the Special Schmuck wants from him. Does the Special Schmuck want Our Hero Luthmann to go to REHAB? Luthmann suspects that he doesn’t have to channel Amy Winehouse to get the answer.
Luthmann’s biggest concern is getting a “fair shake” against the First Family, who have been known to “SHUT UP” their enemies. The First Family operates by misinformation and manipulation of the Feudal Courts. But Our Hero, Luthmann’s cause is true and just.
