Fake Facebook Case Gets Kicked to Brooklyn, Maybe to Die Because of Special Prosecutor Eric Nelson's Errors
In January, Richard Luthmann, now a disbarred lawyer and a former prisoner, now on probation, recently filed a 264-page motion in New York State Supreme Court calling on Justice Marina C. Mundy, who sentenced him in the Fake Facebook case, to throw out the case.

Serious questions and disqualifying actions have been detailed about the appointment of Staten Island Special Prosecutor Eric Nelson.
Nelson’s recent court filing in People v. Luthmann is larded with new perjury by the Special Prosecutor.

We have our answer. Like NFL Hall of Famer Ray Guy, Justice Mundy has become a world-class punter.
Justice Mundy recently signed an Order kicking the People v. Luthmann “Fake Facebook” case to Brooklyn.
The case landed with Judge Donald Leo in the Supreme Court, Kings County Criminal Term. The Judge’s Clerk is looking to schedule a control date to conference Luthmann’s motion to throw out the Fake Facebook case.
Luthmann thinks Justice Mundy made a wise choice. He said, “I’m relieved this case is now off Staten Island and further away from the McMahons. Justice Mundy made a wise choice. Sometimes you can only win by not playing.”
There is speculation as to why Justice Mundy signed an Order moving the case to adjoining Kings County. Some say she recused herself because she may become a witness. Others say it was because of political pressure from the Office of Court Administration. Luthmann disagrees with both those narratives.
“I think Justice Mundy is very adept. While OCA pressure may have played a small role, I think the bigger issue is that she has to deal with the McMahons, Mike as DA in front of her, and Judy in the back rooms of the courthouse. Also, she has to see Ron Castorina back there, at least until they take him away in shackles or OCA smartens up and moves him to a temporary judicial hideout in Queens or the Bronx. I think she made a good move,” Luthmann said.
Overall, Luthmann is happy his case is now off of Staten Island. “Justice Mundy is a Hall of Famer in my book. I don’t know how this case wasn’t moved long ago. Now, maybe I can get some justice. I never appeared in the Staten Island courts after my initial arraignment in November 2018. Eric Nelson saw to that because he violated the Interstate Agreement on Detainers Act (IADA) and didn’t bring me back to New York when I was in Allenwood, even after I made the official requests. This whole case is DOA because of Eric Nelson’s continued prosecutorial errors,” Luthmann said.
Article V(c) of the IADA provides that, subject to continuances granted for good cause in open court in the presence of the prisoner or their attorney, “trial shall be commenced within one hundred and twenty days of the arrival of the prisoner in the receiving [S]tate,” otherwise the indictment shall be dismissed with prejudice.
Luthmann’s papers raise the IADA issue:
Luthmann requested to be brought back to New York State and in front of the New York State Courts to resolve this case in person under the provisions of the Interstate Agreement on Detainers Act (IADA), the procedure authorized by the New York State Legislature for securing the physical appearance of a Defendant held in Federal custody…Luthmann never signed any specialized affidavit constituting a waiver of [his] rights under the IADA. And Luthmann obviously never appeared in open court and specifically waived these rights.
The IADA is codified in New York State under § 580.20 of the Criminal Procedure law.
Special District Attorney Nelson ignored the Federal Government’s official requests under the IADA:
The time to properly bring Luthmann to trial in New York or bring him before the Supreme Court to seek an extension lapsed on September 7, 2020.
“I hope Brooklyn Judge Donald Leo puts an end to this case. But even more, I hope Judge Leo puts an end to Eric Nelson. He is an incompetent prosecutor who has wasted what is probably over $1 million to date on this case. The NYC taxpayers should demand Eric Nelson pays back his ill-earned fees. On top of that, as I said in my papers, he is a liar and a perjurer, and he committed multiple felonies to lodge this defective indictment to satisfy the commands of his political masters.”
Additionally, Luthmann may be coming back to New York:
Luthmann’s request for travel permission is before Magistrate Judge Nicholas P. Mizell in the Middle District of Florida.
It is unclear whether Luthmann will be coming to Staten Island or whether he will have a soap box in tow for use on the corner of Hyatt Street and Central Avenue.
