Nick Chiappetta & Danesh Noshirvan: A Bumbling Legal Circus Backfires Spectacularly

Doxxing, Defamation, and Dodgeballs: Luthmann calls out courtroom chaos in explosive legal feud.

The legal battle between investigative journalist Richard Luthmann and the unlikely duo of SCOTUS Doxxer / TikTok personality Danesh Noshirvan and “dog-bite” attorney Nick Chiappetta took a dramatic turn. Magistrate Judge Kyle C. Dudek denied Luthmann’s motion to quash the subpoena previously served on the journalist and for an order protecting the press based on a technicality.

Despite the denial and a technically defective subpoena, Luthmann insists the fight is far from over. He says Noshirvan and Chippetta will try to serve him again.

“These actions have a chilling effect on journalism and the First Amendment that the federal court was and is duty-bound to protect by the constitution.”

Danesh Noshirvan regularly “doxxes” individuals, publicly providing personal information about them and putting them at risk.

The dispute began when Chiappetta, representing SCOTUS Doxxer Noshirvan, served Luthmann with what he called a “frivolous and bad-faith subpoena” in a federal courtroom in Fort Myers, Florida. Judge Dudek had left the bench seconds before.

The subpoena, directed by Attorney Nick Chiappetta, sought access to Luthmann’s journalistic materials and sources. It threatened to expose sensitive information and undermine press freedoms.

“This subpoena wasn’t just a legal misstep; it was a deliberate attack on the free press,” Luthmann declared in court filings. “Digital Cancel Culture King Danesh wanted to bully me into stopping my reporting on him and sent ‘ambulance chaser’ Nick Chiappetta to do the job. Fat chance.”

Luthmann, who contributes to this outlet, provided background and comments for this article. He also discussed the matter on The Unknown Podcast with co-host and fellow journalist Michael Volpe.

A Subpoena Withdrawn, But Questions Persist

Magistrate Judge Dudek dismissed Luthmann’s motion, saying that procedural technicalities made the controversy “non-justiciable” after Chiappetta withdrew the defective subpoena. However, the ruling failed to address the underlying constitutional issues, leaving Luthmann frustrated but resolute.

“I’m not going to lie. I’m scared to walk into the courtroom and cover this case. That courtroom is no longer a place for justice but a ‘free for all.’ Anything that could happen on a playground or in a back alley could happen to me while I sit there trying to do my job and cover the case - just because I am covering the case. The magistrate judge’s ruling proves the federal court as blind to hijinx as the statute of Lady Justice. But I won’t back down,” Luthmann said.

Luthmann said he’s not afraid of the legal process but the “playground atmosphere” that Noshirvan and his attorney, Nick Chiappetta, created.

Luthmann said that when Attorney Nick Chiappetta served him with a subpoena in a federal courtroom, it turned from a place for justice into a “playground brawl.”

“If he tries to serve me again in the courtroom like it’s some middle-school gym class, I’ll be extremely tempted to use his head as a f—ing dodgeball,” Luthmann said.

Luthmann says Noshirvan and his attorneys have a pattern of assaulting the dignity and decorum of the federal judiciary, first by doxxing the SCOTUS Justices and now by the subpoena’s service, destroying the decorum expected in a federal courtroom.

“Dog Bite Lawyer Nick Chiappetta broke the seal. I know how to behave in a courtroom. I do not intend to lay a hand on Chip or anyone else. But you can only piss on the Constitution so many times before you’ve assumed the risk of what comes next. It’s no different than that idiot who repeatedly f—d with Mike Tyson on the airplane and then wondered why he was counting lightbulbs,” Luthmann said.

In April 2022, during a JetBlue flight from San Francisco to Florida, former heavyweight boxing champion Mike Tyson was harassed by fellow passenger Melvin Townsend III, who reportedly threw a water bottle at Tyson. In response, Tyson punched Townsend multiple times. Prosecutors declined to file criminal charges against Tyson, citing "the conduct of the victim leading up to the incident."

In November 2023, Townsend demanded $450,000 from Tyson to settle the matter without litigation, but Tyson's attorney dismissed the demand as a "shakedown" and refused payment.

“Danesh is no different than the idiot airline passenger, and Chip is another hair-brained ambulance chaser,” Luthmann said. “Danesh already knows the Government said I tried to have people killed. He broadcasted it to his two million followers, knowing those charges never stuck. They were laughed out of court. But don't provoke me and expect to leave unscathed.”

A Questionable Ruling Protects SCOTUS Doxxer Danesh Noshirvan

Luthmann says the magistrate judge's ruling is a big part of the problem. He is bewildered why no federal judges want to give SCOTUS Doxxer Noshirvan a short leash.

The controversy isn’t limited to Chiappetta’s questionable legal tactics. Danesh Noshirvan, known for his incendiary TikTok videos, has a history of doxxing public figures, including Supreme Court justices.

Luthmann’s court filings highlight Danesh’s actions, including publishing the home addresses of justices following the Dobbs decision, leading to a credible death threat against Justice Brett Kavanaugh.

"Your client previously DOXXED the Justices of the United States Supreme Court, revealing their home addresses, places of worship, and the addresses of their children’s schools," Luthmann wrote to Chiappetta.

Luthmann says Noshirvan’s actions violate 18 U.S.C. § 115, prohibiting threats to federal officials.

“No journalist would behave like this,” Luthmann stated. “Danesh’s actions endanger lives and erode public trust. I hope Pam Bondi prosecutes the sh-t out of him.”

Noshirvan’s actions resulted in heightened threats to the judiciary, including a credible death threat against Justice Brett Kavanaugh at his residence. The SCOTUS Doxxer was clear to Dr. Phil that if his actions in identifying and publicizing addresses resulted in death, he was “not his responsibility.”

In his 2024 Year-End Report, Chief Justice John Roberts described doxxing and misinformation as critical threats to the federal judiciary's integrity. He noted that such actions amplify risks of violence and erode public trust in judicial independence.

Luthmann was puzzled by how the court seemingly gave the dangerous Nosirvan a “License to Doxx” as a litigation strategy.

“The magistrate judge doesn’t seem like a bad guy, but he tried to take a quick off-ramp and crashed into a legal brick wall. His order doesn’t resolve the injury to journalism,” he said, highlighting the legal doctrine of “capable of repetition, yet evading review.”

This doctrine, famously upheld in Kingdomware Techs., Inc. v. United States (2016), underscores the need to adjudicate disputes that are likely to recur but avoid judicial scrutiny due to procedural loopholes.

“Danesh and Chip can lie and try to say I’m ‘not a journalist’ all they want. The Obama Administration did the same thing to Glenn Greenwald after he broke the Edward Snowden story. It’s almost as bad as Holocaust denial because if Nazi Germany had a free press, millions of lives would have been saved,” Luthmann said.

Luthmann says the larger issue is that the Court can reasonably expect Noshirvan and his lawyer to re-serve the subpoena on him, maybe at the next court hearing on January 24.

“Chip asked Judge Dudek, who even referenced it in his legal decision, for a chance to amend the subpoena. It’s not gone, and neither is the injury-in-fact to the free press and the justiciable issues before the Court,” Luthmann says. “The Court announced there is a reasonable expectation that a journalist will be re-served with a press-chilling subpoena. Judge Dudek admitted it in black and white. This case is justiciable,” Luthmann said.

Luthmann says the ruling invites more bad faith from Noshirvan and Chiappetta.

“Everyone knows Chip’s using the subpoena not to get evidence but to try to shut down my press coverage. Noshirvan and Chiappetta can’t help themselves but act like thugs. The Court seems, in a pollyannish way, to hope that they will magically stop doxxing innocent people, including public servants, bullying and defaming those who oppose them, and threatening American institutions like the federal judiciary and the Fourth Estate,” Luthmann said. “It’s like taking a pedophile, and instead of the d—k saw or chemical castration, you tell them to ‘behave’ in their new role as a Kindergarten teacher. It’s insane.”

Luthmann promised “strong defensive measures” for his “personal protection” and the free press.

“I can go directly to the Eleventh Circuit with this, which I might do. Or I could ask the Article III Judge to reconsider based on the law of standing and justiciability, which was clearly ignored,” Luthmann said.

A request for reconsideration would go before U.S. District Court Judge John Steele, a Bill Clinton appointee.

“Reconsideration might be an exercise in futility. I heard that Clinton is getting an aircraft carrier named after him. And like everything else from his administration, it will be covered with seamen,” Luthmann chuckled.

The most colorful moments unfolded in the email exchanges between Luthmann and Chiappetta. Luthmann did not hold back, calling Chiappetta’s legal skills into question with sharp wit and biting commentary.

At one point, Luthmann’s podcast co-host, journalist Michael Volpe, referred to Chiappetta as “Chia Pet” during a heated exchange on The Unknown Podcast.

“Nick Chiappetta doesn’t know the law, and he doesn’t know when to quit,” Luthmann quipped. “He’s the kind of lawyer who makes other lawyers cringe, particularly as his client may very well be the agent of a foreign enemy.”

The exchange escalated when Luthmann brought up broader ethical and legal concerns. Luthmann, a recent crime victim in Florida, invoked Marsy’s Law and copied an extensive list of legal and public officials, further escalating the dispute's visibility.

Chiappetta sent Luthmann a picture of the journalist receiving emergency medical treatment from Dr. Garramone. Luthmann felt that this was harassment of a crime victim who cooperated with the authorities. In his reply, he copied the State Attorney’s Office, the Sheriff’s Office, and members of the Florida Bar Ethics Committee.

Luthmann’s remarks on the limitations of the legal system were equally pointed. He said his decision to cooperate with authorities as a crime victim should not be ridiculed or impugned by “some a—hole dog-bite lawyer.”

“If the courts can’t protect journalists or crime victims under Florida’s Marsy’s Law, maybe it’s time to consider private justice,” he said, referencing the constitutional protections often overshadowed by procedural hurdles.

“The law should be a shield against, not a sword for opportunists like Nick Chiappetta and Danesh Noshirvan. Or else, why would anyone cooperate with authorities, even as a victim?”

The Final Verdict?

Despite the procedural dismissal of the subpoena, Luthmann says he should be able to get redress in federal court. He remains determined to seek justice, hinting at reconsideration or appeal, First Amendment lawyers, and broader implications for press freedom.

“I’m not currently under subpoena and may have to destroy my materials and hand a copy to another journalist or an attorney to protect my sources,” he lamented. “This chilling effect is exactly what the First Amendment was designed to prevent. It’s not outlandish to compare these tactics, now implicitly court-sanctioned, to a Nazi SS raid.”

Luthmann’s concerns extend beyond his case. He worries about the precedent this sets for other journalists.

“If unethical lawyers and bad-faith litigants like Chiappetta and Danesh can target journalists without consequence, who will hold the powerful accountable?” Luthmann said.

While the Florida federal court’s decision may have temporarily removed the issues from the docket, the battle for press freedom rages on. Luthmann’s fight against Chiappetta and Danesh underscores the fragility of constitutional rights in the face of bad-faith litigation.

As Luthmann himself put it, “This is bigger than me. It’s about preserving the very fabric of our democracy.”
